General Terms and Conditions of Cooperation in the Organization of Travel
§1 Subject of the Сontract
MUNDO Limiteda company (hereinafter - "MUNDO.PRO"), through its representative Jose Ignacio Gonzalez Marquez offers its services on the website http://mundo.pro/en, on basis of which the online user (hereinafter - "Partner"), has the opportunity to develop a career, business and provide services related to tourism and real estate, namely:
- post information on any objects of temporary accommodation such as hotels, motels, hostels and small hotels such as "Bed and Breakfast", collectively referred to as "the object (s) of accommodation" and exhibit rooms for reservation to provide visitors of MUNDO.PRO with an opportunity to book these rooms;
- place information about car rentals for the MUNDO.PRO visitors to book selected cars;
- post information on the organization of tours and excursions, to provide transfer services, interpreters, personal guides and other services related to the organization of travel;
- offer an opportunity for cafes and restaurants to post information on culinary traditions and its menu and MUNDO.PRO visitors an opportunity to book a table and pay in advance;
- offer agents and real estate agencies to post information, ads for various real estate objects (apartment houses, commercial real estate) put up for sale by any individuals or organizations.
The partner is able to offer all of these services to book for a specific date, time and opportunity to pay their potential customers. The partner can also provide potential users services of buying and selling real estate.
For the placement of services the Partner, in case other users have made reservations and payment on the site mundo.pro, leaves MUNDO.PRO. commission of 10% of the total payment. MUNDO.PRO does not independently leases objects of temporary accommodation, cars, does not provide services related to catering and is not involved in the organization of tours or trips, does not provide services for the purchase or sale of real estate according to the Law of Spain №34/2002 dated July 11, "On Information Society Services and Electronic Commerce", and is not an agent in the providing of other services. The contract of partnership in the sphere of travel is signed solely between the partners and MUNDO.PRO. These Terms of Use contain the final regulations on mediation in organizing tours and purchase or sale of real estate between MUNDO.PRO and partners. However, they are not implemented for negotiated settlement services through mediation. The rules that deviate from these terms will be valid only if they are confirmed in writing by MUNDO.PRO.
§2 Terms of Use
This Partnership Treaty is possible only if the Partner has the official license and liability insurance contract, issued by the country in which he operates. With the license, the Partner is registered on MUNDO.PRO site, thus expressing his agreement to the Terms of Use and Privacy Policy. After the registration and signing of this Partnership, the Partner gets the opportunity to place on MUNDO.PRO site their objects of temporary accommodation, providing information on car rental, and ads for buying and selling a variety of real estate objects, information and services in the organization of tours and excursions, providing transfer services, interpreters, personal guides and other services, related to the organization of travel. Cafes and restaurants will be able to post information on the culinary traditions, menu, price, location and schedule of work, as well as other necessary information.
Since the moment of registration and signing of the Agreement with MUNDO.PRO on the sight the Partner has the right for the free use of MUNDO.PRO for three years.
After the expiration of this period:
When choosing and booking the object of temporary accommodation, car rental, tours, transfer services, an interpreter, a personal guide, cafes or restaurants, as well as any other services related to the organization of travel, hosted by the Partner, users make their payment, 90% of which is immediately transferred to the bank account of the Partner, as a fact of confirmation of booking and ordering of selected services, and 10% remains on MUNDO.PRO account as commission. At the same time, the Partner receives an e-mail to the page and to MUNDO.PRO site, confirming the fact of booking and payment of the selected services, tour, excursions or other services related to the organization of travel, the name and the last name of the User, the email address,the phone number of the User, the address of temporary residence, the length of the services, sightseeing tours, the cost, date and the time of the residence,the order.
The User,as the confirmation of the selected and paid services, receives an electronic document with the following information:
- The country, the region, the city and the name of the object of temporary accommodation, the address of its location on the map Google, of the information about the reservation, date and time of residence, additional information on the selected services, e-mail, telephone, cost;
- The country, region, city and the name of the company to provide car rental services, the address of its location on the map Google, car model, information on additional options, the date and time of rental, e-mail, telephone, cost;
- The country, the region, the city and the name of the tour, excursions or other services related to the travel organization, the name and the surname of the guide, their email addresses, locations of the sightseeing tour, the date, the cost.
An electronic document (voucher) is sent to the user immediately after the money gets to MUNDO.PRO account. The voucher also serves as the confirmation of booking and payment produced by the User.
In case the user refuses to get paid services related to the organization of the travel, more than three days in advance, 10% of the money paid by the User, remains as a compensation to the Partner, and 90% of the money is returned to the User. If the User refuses to get paid services related to the organization of the travel, less than three days in advance, the money will not be returned to the User (except for emergency cases, such as a disaster, accident, death, etc.)
§3 Trading Agreement
MUNDO.PRO does not assume any guarantee for trading agreements between the Partner and the User and their execution as well as liability for defects on purchased services related to the organization of travel. MUNDO.PRO is not obliged to enforce the agreements concluded between the Partner (the service provider) and the User.
§4 Prices
Prices, indicated by the Partner for temporary accommodation, tours, and other services related to the organization of travel on your web page of MUNDO.PRO must necessarily include the official value added tax, if any, as well as other price components . Prices must be quoted in euros, but the user is free to choose any available currency. The price is always presented for the User in the selected currency. The risk of exchange rate fluctuations is the responsibility of MUNDO.PRO.
§5 Responsibility
MUNDO.PRO assumes no responsibility for the activities, actions or omissions of the Partner. MUNDO.PRO is only liable for damages for breach of essential duties under the contract (fixed fee). The main responsibilities are contractual obligations, the fulfillment of which makes the performance of the contract possible in principle, and which comply with the contract the Partner could trust. MUNDO.PRO has the right to verify all information placed by the Partner on the MUNDO.PRO site, for its conformity with International Law, the general rules of human morality and rules of conduct, and does not violate the information rights of third parties. In case MUNDO.PRO regards the information, not consistent with International Law, violates the general rules of human morality and rules of conduct, rights of third parties MUNDO.PRO has the right to block the page of the Partners to eliminate discovered violations by the Partner until the Partner presents written evidence that this information is fully consistent with International Law, the general rules of human morality and rules of conduct MUNDO.PO has the right to remove the disputed information, MUNDO.PRO reserves the right to terminate this agreement and to remove all the information about the Partner and its services.
§6 Data Protection
The Information about the partners is collected only within the framework of the execution of this contract. It complies with the law of Spain №34/2002 dated July 11, "Information Society Services and Electronic Commerce", as well as Spanish legislation №15/1999 dated December 13, "Protection of Personal data". §7 Final Provisions
General terms and conditions of this contract are governed by prudential regulations of the Kingdom of Spain and the European International Law. European and International Law of compulsory legal protection of consumer choice exclude the country, where the buyer has his permanent place of residence (that is, living in the country for more than 185 days per year).
If any term or provision of this Partnership Agreement is lost or invalid or contrary to the Law, it does not affect the validity of the remaining terms and conditions of the Partnership Agreement. The invalid term or provision, in this case, should be replaced by the mutual agreement of the contracting parties and, is legally binding, and is more suitable for the economic essence of the Partnership Agreement.
Note: All terms and conditions of this Partnership Agreement together with the Spanish version presented in other languages serve information purposes only. The translations are made for the sake of good will. In case of discrepancies or deviations, the Spanish version takes precedence. In addition, in all matters relating to the interpretation of this agreement, you must also use European and International Law as a priority.
